# Toy Safety Compliance Matrix 2026: ASTM F963 & CPSIA (US) vs EN 71 (EU) vs UKCA (UK) vs QCVN 3 (Vietnam)

Toy Safety Compliance Matrix 2026 comparing ASTM F963, CPSIA, EN 71, UKCA and QCVN 3 standards

**Key takeaways**

- **A standard belongs to a market:** ASTM F963 and CPSIA for the US, EN 71 for the EU, the UK's toy regulations for Great Britain, QCVN 3 for retail in Vietnam. Passing one does not cover the others.
- **Declare every market at inquiry:** the markets decide which partner factory is eligible, the test scope, the cost and the schedule.
- **The EU is changing:** Regulation (EU) 2025/2509 replaces the 2009 directive, with its main rules applying from 1 August 2030.
- **Gifts are not retail:** corporate gifts given away in Vietnam need only a VAT invoice, not QCVN 3.

Toy safety requirements are set by the country where a toy is sold. The United States requires ASTM F963 and CPSIA testing at a CPSC-accepted lab, the EU requires EN 71 testing and CE marking, Great Britain applies its own toy regulations with UKCA or accepted CE marking, and Vietnam requires QCVN 3 and the CR mark for retail sale.

This matrix puts the four sets of rules side by side for importers, brand owners and licensors who make plush and toys in Vietnam. It is a planning tool, not legal advice: requirements change, and the accredited lab and the importer remain responsible for confirming them for a specific product.

## 1. The matrix: four markets side by side

| | United States | European Union | Great Britain | Vietnam (retail) |
| --- | --- | --- | --- | --- |
| **Core rule** | ASTM F963, mandatory under 16 CFR 1250; CPSIA | Toy Safety Directive 2009/48/EC, being replaced by Regulation (EU) 2025/2509 | Toys (Safety) Regulations 2011 | QCVN 3:2019/BKHCN |
| **Main tests** | ASTM F963: mechanical and physical hazards, flammability, heavy elements | EN 71-1 mechanical and physical, EN 71-2 flammability, EN 71-3 migration of certain elements | Designated BS EN 71 standards | QCVN 3 toy safety tests |
| **Chemicals** | Lead: 100 ppm in substrate, 90 ppm in paint and coatings; eight phthalates above 0.1% banned in accessible plasticized parts | EN 71-3 element limits; REACH restrictions and SVHC disclosure above 0.1% | BS EN 71-3; UK REACH | Within QCVN 3 testing |
| **Who tests** | CPSC-accepted third-party lab | Accredited lab; notified body where the rules require one | Accredited lab | Designated testing lab |
| **Document** | Children's Product Certificate, issued by the importer | Safety assessment, technical file, EU Declaration of Conformity (a digital product passport under the new regulation) | Technical file and UK Declaration of Conformity | Registered conformity announcement |
| **Marking** | Permanent tracking labels on product and packaging | CE marking | UKCA, or CE where Great Britain accepts it | CR mark |
| **Labels and warnings** | Choking-hazard warnings for ages 3 to 6 where small parts apply; state stuffed-article law labels (for example Pennsylvania, Ohio, Massachusetts) | Manufacturer and EU importer or responsible person, product identifier, warnings in each country's language | UK importer name and address | Vietnamese label under Decree 43/2017, amended by Decree 111/2021 |

## 2. Heavy elements: EN 71-3, ASTM F963 and CPSIA are not interchangeable

Buyers often ask whether an EN 71-3 report "covers" lead for the United States. It does not, because the three rules measure different things:

| Rule | What it measures |
| --- | --- |
| EN 71-3 (EU, UK) | Migration of certain elements from toy materials, with limits that depend on the material category |
| ASTM F963 heavy elements (US) | Soluble heavy elements in paints, coatings and accessible substrates |
| CPSIA lead (US) | Total lead content: 100 ppm in substrate materials and 90 ppm in paint and surface coatings of children's products |

## 3. By product type

| Product | What to plan for |
| --- | --- |
| Plush and stuffed toys | The core toy tests of each market. For the US, add the state stuffed-article law label. Seams, eyes and small parts are pulled and checked in the mechanical tests. |
| Toys with batteries or electronics | US: FCC Part 15 for electronics and Reese's Law (16 CFR 1263) for button and coin batteries. EU: EN IEC 62115 for electric toys and the CE electrical directives. A UN 38.3 battery test summary for shipping. |
| Figures and blind boxes | Phthalate testing on accessible PVC or vinyl parts for the US; small-parts warnings where they apply. Collectibles labeled for teens or adults can still be treated as children's products if their design or marketing appeals to children under 12, so document the age grading first. |
| Licensed or major-retailer programs | The licensor's approvals and, for some programs such as Disney FAMA, production only at an authorized partner factory; retailers often set their own test protocol and require a social audit such as amfori BSCI or Sedex SMETA. |

## 4. Four rules that save time and money

1. **Specify requirements at inquiry, confirm them in the contract.** Required certifications, audits and test reports determine which partner factories are eligible, the testing scope, and the resulting cost and schedule. Requirements introduced after production has started may require re-sampling, additional testing or a change of facility.
2. **Standards differ by country and by sales channel.** Each destination market, and often each retailer or licensor, sets its own requirements. Where goods will be sold in several markets, declare all of them upfront so that testing covers every destination.
3. **Higher-tier programs require meaningful order volumes.** Disney FAMA, amfori BSCI and Sedex SMETA are held by a limited number of qualified facilities and are generally practical for relatively large orders. For smaller runs, the appropriate assurance is usually product-safety testing to the destination market's standard.
4. **Vietnam corporate gifts that are not sold need no certificate.** Gifts to staff, clients or event guests need only a full, valid VAT invoice. QCVN 3 and the CR mark apply when toys are sold at retail in Vietnam.

## Who does what

Takara holds no certifications itself. Accredited labs test the products, partner factories hold their audit certificates, and the importer issues the certificate or declaration its market requires. Takara's role is to specify the requirements with the client, assign an eligible partner factory, arrange testing and check that every document and label is in place before the goods ship.

## Frequently asked questions

**Is EN 71 the same as ASTM F963?**

No. EN 71 is the European toy standard and ASTM F963 is the mandatory US toy standard. They cover similar ground (mechanical hazards, flammability, heavy elements) but with different tests and limits, and each market needs its own reports, so a product tested to one is not automatically compliant with the other.

**What does a plush toy need to be sold in the United States?**

ASTM F963 testing and CPSIA testing (lead and, for accessible plasticized parts, eight restricted phthalates) at a CPSC-accepted third-party lab, a Children's Product Certificate issued by the importer, permanent tracking labels, choking-hazard warnings where small parts apply, and in some states a stuffed-article law label.

**What changes with the new EU Toy Safety Regulation?**

Regulation (EU) 2025/2509 replaces the Toy Safety Directive 2009/48/EC. It was published on 12 December 2025 and its main rules apply from 1 August 2030, when a digital product passport replaces the EU declaration of conformity. Confirm the exact dates for your product on EUR-Lex or with your lab.

**Do corporate gifts in Vietnam need QCVN 3?**

No, if they are given away and not sold. Gifts to staff, clients or event guests need only a full, valid VAT invoice. QCVN 3 testing and the CR mark apply when toys are sold at retail in Vietnam.

**Does Takara hold these certifications?**

No. Testing is done by accredited labs and factory audits are held by partner factories. Takara specifies the requirements at inquiry, assigns an eligible partner factory, arranges testing with an accredited lab and checks the documents before shipment.
